  • A COURT OF A MEMBER STATE MAY NOT MAKE AN ORDER TO RESTRAIN A PERSON FROM COMMENCING CIVIL PROCEEDINGS BEFORE A COURT OF ANOTHER MEMBER STATE, EVEN IF SUCH PROCEEDINGS MAY BE CONTRARY TO AN ARBITRATION AGREEMENT
  • The Court of a member state may not make an order to restrain a person from commencing civil proceedings before a court of another member state, even if such proceedings may be contrary to an arbitration agreement. The Court finds that the order to restrain would obstruct a court of another Member State in the exercise of the powers conferred on it by the regulation. Moreover, such an injunction could undermine the trust which the Member States accord to one another’s legal systems and judicia institutions and on which the system of jurisdiction under the regulation is based
